2. CERTAIN CONDITIONS.
(a) For any Member's discount or other benefit to apply, the Membership account must be active and available at the time of purchase. Members will NOT be reimbursed retroactively for purchases made without a Member discount at the time of purchase.

(b) Member's everyday discount is only valid on eligible purchases at any Lettermen Sports and online at www.lettermensports.com. The Member's everyday discount is not available on the purchase of any of the following items: Gift Cards; shipping or handling fees; custom apparel orders, custom retail lettering, or Membership fees (new or renewal).

(c) Member pricing cannot be combined with any other promotions, discounts, or coupons. If a current promotion, discount or coupon is more beneficial to the customer, that promotion/discount/coupon will be used.

(e) Memberships are non-transferable and are only valid for immediate family purchases. All immediate family members may be put under one account upon purchase of membership. When used online at www.lettermensports.com, a Member number may only be associated with one www.lettermensports.com account.

(f) We expect Members to submit and maintain accurate and current user information in connection with their Memberships. Such information includes name, address, email address, and telephone number. Members can change their account information by (i) completing an Update Member Profile form at any Lettermen Sports, or (ii) calling us at 1-888-780-8077. We cannot assume any liability for correspondence, mail or email, that is lost, delayed, or misdirected.

3. MEMBERSHIP FEE.
The annual Membership fee is currently $25. We may change the Membership fee at any time, but changes will apply only to new and renewal Memberships. The fee is not refundable.

4. TERM; CONTINUOUS MEMBERSHIP; BILLING.
The initial term of a Membership shall commence on the date it is purchased and continue until one year from the last day of the calendar month in which the Membership was purchased. Each Membership will automatically renew (each a "Renewal Membership") each year for additional one-year periods commencing on the day after the anniversary of the last day of the calendar month in which the Membership was purchased (referred to as "Continuous Membership") unless (i) you elect a one-year Membership by opting out of Continuous Membership at enrollment; (ii) you pay for your Membership with cash, check, or Lettermen Sports Gift Card; (iii) you notify us by telephone, at 1-888-780-8077, of your decision to opt out of Continuous Membership; or (iv) we terminate your Membership.

Renewal Membership fees will be billed annually and automatically to the credit card we currently have on file, in the amount of the then current Membership fee on the first day of the month in which your current Membership or Renewal Membership term expires.
When you enroll at a Lettermen Sports, the Renewal Membership fee will be billed to the credit card used to enroll in the Lettermen Sports Member Program, or the credit card we currently have on file which you provided to us at either the time of enrollment or the time of renewal. If you enroll online at www.lettermensports.com and Continuous Membership is selected, the Renewal Membership fee will be billed to the credit card that is active in your www.lettermensports.com account.

5. CANCELLATION; TERMINATION.
(a) You have the right to cancel your Membership at any time. Your membership fee will not be reimbursed either in full or pro rata.

If you purchase a Membership at a Lettermen Sports you can cancel your Membership by contacting Lettermen Sports.

If you purchase your Membership online at www.lettermensports.com, you can cancel your Membership by (i) calling us at 1-888-780-8077 or (ii) contacting us via email at nick@lettermensports.com

(b) We may terminate your Membership, including any associated accounts, without notice, for any reason in our sole discretion, including without limitation our belief that continued use of such Membership would violate any provisions of this Agreement, applicable law, or otherwise be harmful to our interests. In the event of any such termination, your membership fee will not be refunded.

(c) We may terminate any or all of the benefits available under the Lettermen Sports Member Program at any time with or without notice. In the event of our termination of this program, at our election we will maintain your Membership benefits until expiration of the Membership current term.

6. DISCLAIMERS; LIMITATION OF LIABILITY.
USE OF THE LETTERMEN SPORTS MEMBER PROGRAM AND ANY OF ITS ASSOCIATED BENEFITS IS AT YOUR SOLE RISK. THE MEMBERSHIP BENEFITS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

LETTERMEN SPORTS, AND ALL OF THEIR RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS AND AGENTS (COLLECTIVELY "MEMBERSHIP PROVIDERS") EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

MEMBERSHIP PROVIDERS MAKE NO WARRANTY THAT (i) THE LETTERMEN SPORTS MEMBER PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) THE LETTERMEN SPORTS MEMBER PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU FROM YOUR USE OF THE LETTERMEN SPORTS MEMBER PROGRAM WILL MEET YOUR EXPECTATIONS.

MEMBERSHIP PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MEMBERSHIP PROVIDER HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE LETTERMEN SPORTS MEMBER PROGRAM OR ANY BENEFITS THEREOF; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED VIA THE USE THE LETTERMEN SPORTS MEMBER PROGRAM; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR THE LETTERMEN SPORTS MEMBER PROGRAM DATA; OR (iv) ANY OTHER MATTER RELATING TO THE LETTERMEN SPORTS MEMBER PROGRAM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

7. ACKNOWLEDGMENT.
This Agreement, including all documents referenced herein, represents the entire understanding between us and any user of the Lettermen Sports Member Program with respect to the Lettermen Sports Member Program and supersedes any other agreements, statements or representations. Headings used in this Agreement are for reference only and shall not affect the meaning of any terms. Any user of any portion of the Lettermen Sports Member Program is deemed to have accepted the terms and conditions of this Agreement.

8. CHANGES TO THIS AGREEMENT.
We may change the terms of this Agreement at any time by posting a revised Agreement on the Member Program inside all Lettermen Sports locations. We may also notify Members of such change in writing either by regular mail or via email to the email address in the Member's account. Any change shall take effect immediately, unless otherwise provided. You may view the current version of this Agreement at any Lettermen Sports location or you may obtain a copy of it by calling 1-888-780-8077. Courtesy copies are also available at Lettermen Sports.
